1. Acceptance of Terms

By downloading, installing, or using AlpaFit, you agree to be bound by these Terms of Service. By creating an account or purchasing a subscription, you additionally agree to the subscription-specific terms below. If you do not agree to these terms, you must not use the application.

2. Description of the Service

AlpaFit is a fitness application that allows users to track workouts, monitor progress, record fitness activities, and plan training schedules. The app is provided on an "as is" basis and is intended solely for personal, non-commercial use.

AlpaFit offers a free tier (with advertisements) and a premium subscription (AlpaFit Max) that removes ads and unlocks additional features including Coach Alpa AI assistant, advanced statistics, and personal records tracking. Cloud sync is enabled by default for signed-in users to back up their data and allow access across devices. Users can disable cloud sync at any time in the app settings.

3. Minimum Age

You must be at least 16 years old to use AlpaFit. If you are under 16, you may only use AlpaFit with the consent and supervision of a parent or legal guardian. By using AlpaFit, you confirm that you meet this age requirement.

4. User Accounts

Use of AlpaFit is possible without creating an account. If you choose to sign in using Apple or Google, you are responsible for maintaining the confidentiality of your credentials and for all activities carried out under your account.

5. Subscriptions and Payments

5.1 AlpaFit Max Subscription

AlpaFit Max is available as an auto-renewing subscription with the following plans:

  • Monthly: $0.99 per month
  • Yearly: $9.99 per year

Prices may vary by region and are displayed in your local currency at the time of purchase in the app. The prices listed above are base prices and may be subject to change.

5.2 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period at the same price, unless pricing changes are communicated in advance.

5.3 Cancellation

You may cancel your subscription at any time through your device's subscription settings:

After cancellation, you retain access to AlpaFit Max features until the end of your current paid period. No partial refunds are issued for unused portions of the subscription period.

5.4 Refunds

All purchases are processed by Apple or Google. AlpaFit does not directly process payments and cannot issue refunds. To request a refund, please contact Apple Support or Google Play Support according to their respective refund policies.

5.5 Free Trial

If a free trial is offered, it automatically converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Free trial eligibility is determined by Apple or Google.

6. Advertising

The free tier of AlpaFit displays advertisements powered by Google AdMob. Advertisement content is provided by Google and third-party advertisers. AlpaFit is not responsible for the content, accuracy, or legality of third-party advertisements. Users may upgrade to AlpaFit Max to remove all advertisements.

7. Cloud Sync and Data

Cloud sync is enabled by default for signed-in users, backing up fitness data and enabling access across devices. You can disable cloud sync at any time in the app settings. AlpaFit is also fully functional in offline or guest mode with all data stored locally on your device.

Data processing via cloud sync is subject to our Privacy Policy. AlpaFit is not liable for data loss on your device if you do not use the cloud sync feature.

8. User Conduct

You agree to use the app only for lawful purposes. You must not misuse the app in any way that could damage, disable, or impair the service. You are solely responsible for the accuracy and legality of any data you enter.

9. Intellectual Property

All content, features, and functionality of AlpaFit, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of the app operator and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

10. Health and Fitness Disclaimer

AlpaFit is a fitness tracking tool and is not a medical device. The information, statistics, and features provided — including workout tracking, calculated metrics (RPE, estimated 1RM), and AI-powered suggestions (Coach Alpa) — are for general informational and fitness tracking purposes only and do not constitute medical advice, diagnosis, or treatment.

You should consult a qualified healthcare professional before starting any new exercise program, especially if you have pre-existing health conditions, injuries, or concerns. AlpaFit is not responsible for any injuries or health issues that may occur during workouts tracked in the app.

Calculated metrics such as estimated one-repetition maximums (1RM), RPE-based suggestions, and volume analyses are mathematical approximations and may not reflect your actual physical capabilities. AI-powered features provide general fitness suggestions and are not a substitute for professional training or medical guidance.

11. Disclaimer of Warranties

The app is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the app will be uninterrupted, error-free, or free from defects. The accuracy of statistics, calculations, and AI-generated content is not guaranteed.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the app operator shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the app, including but not limited to personal injury, data loss, loss of profits, or business interruption.

To the extent permitted by law, the total liability of the app operator for any claims arising from or relating to the use of AlpaFit is limited to the amount you paid for the service in the 12 months preceding the event giving rise to the claim.

Under German law (BGB), liability for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit) cannot be excluded. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

13. Third-Party Platforms

AlpaFit is distributed via the Apple App Store and Google Play Store. By using the app, you are also subject to the applicable terms of service of these platforms. All payment processing for subscriptions and in-app purchases is handled entirely by Apple or Google. AlpaFit does not collect or store your payment card information.

14. Termination

You may discontinue use of the app at any time by uninstalling it. If you have an account, you may delete it via app settings or our account deletion page. Upon account deletion, all cloud-synced data will be permanently deleted from our servers within 30 days.

We reserve the right to suspend or terminate access to the app if these Terms of Service are violated. Cancelling your subscription is separate from deleting your account — please ensure you cancel your subscription through Apple or Google before deleting your account to avoid further charges.

15. Changes to These Terms

We reserve the right to amend these Terms of Service at any time. Changes will be indicated by updating the "Last Updated" date above. Continued use of the app after changes take effect constitutes acceptance of the revised terms. For significant changes, we will provide notice through the app.

16. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and conflict of law provisions.

For disputes with consumers residing in the European Union, the courts at the consumer's place of residence shall have jurisdiction in accordance with applicable EU regulations. For all other disputes, the courts of Dortmund, Germany shall have exclusive jurisdiction.

17. EU Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
